Sec. 5. Should a councillor go on a journey, so that it is impos- sible for hi to attend the meetings of the council regularly, he may appoint a substitnte, who shall act for him in his absence.

Sec. 6. Certain days shall be sct apart for council and court days

Sec. 7. The ehiefs and councillors shall appoint three sherifs, at a salary of one lundred and fifty dollars per anuun cach; one clerk, at one lundred dollars per annum; and one jailer, at a sal ary of one lundred dollars per annum, wlhose Balary shall be due and payable half-yearly; and in case cither of the above olicers shall negiect or refuse to perform any of the duties of his office. le shall forfeit lis salary, and lis office shall be declared vacant, and anotlher shall be appointed to fill the ofice.

See. 8. The chiefs and councillors slhall semi-annually, in April and October, nake an appropriation for national expenses, which appropriation shall be taketn from the trust fund, or any other due the Delawares, and paid to the treasury

See, 9, There shall be a treasurer appointed aunually, on the first day of April, whose duty it shall be to receive and disburse all moneys to be used for national purposes; but the treasurer shall pay out moncy only on order of chiefs and councillors, and for his serviees shall be paid five per cent. on the amount dis burscd.

Article VII

Sec. 1. It shall be lawful for any person, before his or her deatlh, to make a will, and thereby dispose of his or her property as he or she may desire

Sec. 2. 1f a nian dies, learingg no will to show the disposal of his property, and leaves a widow and clildren, one-fourth of his property shall be set aside for the payment of his debts. Should the property so set aside be insufficicnt to pay all lis debts in full, it shall be divided among his creditors pro rata, which pro rata pay- ment shall be reccived by 1his creditors in full satisfaction of all elaims and demands whatever.

Sec. 3. If the propcrty so set apart for the payment of debts is more than sufficient to pay ail debts, the remainder shall be eqnal ly dividcd among the children

Sec. 4. The widow shall be entitled to one-third of the property not set aside for the payment of debts.

Sec. 5. If man dies, leaving no widow or children, his debts shall first be paid out of the procccds of his personal property,
